In today’s market anything and everything can be branded, even an individual if proven a viable market entity. It seems fitting somehow that it is all up for sale or at least a good bidding. So in this big sea of trademarking, what exactly does a trademark consist of?

It is advisable to check the country, region, state, city, as to decide what sites to search to make sure one gets the proper information based on region.
Trademarks also include what is termed infringement, which falls under the definition of if one uses the trade sign in conduction with identical products or services, for which it is registered. Also creating an unfair advantage of the identical or similar to a reputable trademark with due cause. When a trademark has been registered it is protected under this term of infringement as well, it helps in the cases of misuse, or improper use of a specific trademark.
A Trademark or TM or service market SM may still be used with registering with the USPTO but remember registering is what gives the protection under the trademark law should any circumstances arise.
